  • 8.1 Generally. Franchisee shall acquire all Inputs required by Bombs Away Franchising from time to time in accordance with System Standards. Bombs Away Franchising may require Franchisee to purchase or lease any Inputs from Bombs Away Franchising, Bombs Away Franchising's designee, Required Vendors, Approved Vendors, and/or under Bombs Away Franchising's specifications. Bombs Away Franchising may change any such requirement or change the status of any vendor. To make such requirement or change effective, Bombs Away Franchising shall issue the appropriate System Standards.

According to Bombs Away's 2024 Franchise Disclosure Document, Bombs Away Franchising has the authority to mandate franchisees to purchase or lease inputs from specific sources, including Bombs Away Franchising itself, its designees, required vendors, or approved vendors, or according to Bombs Away Franchising's specifications. Inputs are defined as any goods, services, supplies, fixtures, equipment, inventory, computer hardware and software, real estate, or comparable items related to establishing or operating the Business.

To implement any new requirement or change the status of a vendor, Bombs Away Franchising will issue the appropriate System Standards. System Standards are defined as the then-current mandatory procedures, requirements, and/or standards of the System as determined by Bombs Away Franchising. These standards can include procedures, requirements, and/or standards for various aspects of the business, such as appearance, business metrics, cleanliness, customer service, design, equipment, inventory, marketing and public relations, operating days, operating hours, presentation of Marks, product and service offerings, quality of products and services, reporting, safety, technology, uniforms, and vehicles.

This means that Bombs Away franchisees must adhere to the vendor requirements and changes communicated through the System Standards. If a franchisee wishes to use an alternate vendor or input, they must seek approval from Bombs Away Franchising, providing all necessary information and samples. Bombs Away Franchising will then provide written notification of approval or disapproval within 30 days of receiving the franchisee's request. Bombs Away Franchising may negotiate prices and terms with vendors on behalf of the System and may receive rebates or other consideration from vendors based on franchisee purchases.
