What This Means (2024 FDD)
According to Bombs Away's 2024 Franchise Disclosure Document, Bombs Away Franchising exclusively owns all customer data and other non-public data generated by the Bombs Away business. However, Bombs Away Franchising licenses this data back to the franchisee without charge. This license allows the franchisee to use the data solely in connection with their Bombs Away business during the term of the Franchise Agreement.
This arrangement means that while franchisees collect valuable customer information in their daily operations, they do not own that data outright. Instead, they have a limited license to use it for their franchise. This is a common practice in franchising, as it allows the franchisor to maintain control over brand-related data and ensure consistency across the franchise system.
For a prospective Bombs Away franchisee, this clause has several implications. First, the franchisee must understand that the customer data they gather is ultimately the property of Bombs Away Franchising. Second, the franchisee's use of this data is restricted to activities directly related to operating their Bombs Away franchise. Finally, upon termination of the Franchise Agreement, the franchisee loses the right to use this data, which could impact their ability to market to former customers or leverage that information in any future business ventures.
