Grant of Territory

Your franchise agreement will specify a territory, which will have a population of a minimum of 500,000 people. This will then be weighed against the population base's income levels per household. The boundaries of your territory will be specified by zip codes, county or city lines, or some other limit.

Relocation; Establishment of Additional Outlets

You may relocate your business headquarters anywhere in your territory.

You do not have the right to establish additional franchised outlets or expand into additional territory.

According to Bombs Away's 2024 Franchise Disclosure Document, a franchisee's territory will be specified in the franchise agreement and will have a minimum population of 500,000 people. Bombs Away grants an exclusive territory to its franchisees, meaning that Bombs Away will not establish another company-owned or franchised outlet selling similar goods or services under the same trademarks within the franchisee's territory. The continuation of this territorial exclusivity is not dependent on any specific conditions, and Bombs Away does not have the right to modify these territorial rights.

However, Bombs Away retains certain rights within the franchisee's territory. They may serve customers (or authorize other franchisees to do so) if the franchisee is in default or unable to meet customer demand. They can also serve a specific customer if the franchisee fails to serve them properly or if Bombs Away believes the franchisee will not provide adequate service. Bombs Away also reserves the right to use other distribution channels, like the internet or direct marketing, to make sales within the territory, provided they are for different products or services or use different trademarks. Franchisees are restricted from soliciting or marketing to potential customers outside their territory, except for marketing efforts primarily targeted within their territory that may incidentally reach customers outside of it. Serving customers outside the territory requires prior written permission from Bombs Away, which can be withdrawn at any time.
