What This Means (2025 FDD)
According to Big Apple Bagels' 2025 Franchise Disclosure Document, the franchisor has extensive rights to inspect a franchisee's store to ensure compliance with the franchise agreement. Big Apple Bagels, or its designee, can inspect the store at any time during business hours without prior notice. This includes the right to photograph and videotape the store's operation, whether continuously or intermittently, as deemed necessary by the franchisor.
Additionally, Big Apple Bagels has the authority to remove samples of products and supplies for inspection. They can also interview store personnel and customers. The franchisee is obligated to fully cooperate with these inspections. However, the franchisor states that it will not interfere unreasonably with the store's operation while exercising these rights.
These inspection rights allow Big Apple Bagels to monitor adherence to brand standards, operational procedures, and the overall quality of the franchisee's business. For a prospective franchisee, this means being prepared for unannounced visits and audits, and maintaining meticulous records and store conditions to meet the franchisor's expectations. Failure to comply with these standards could lead to further scrutiny or penalties as outlined in the franchise agreement.
