What This Means (2025 FDD)
According to Big Apple Bagels' 2025 Franchise Disclosure Document, the availability of an exclusive territory depends on the agreement type. A standard prospective franchisee searching for a location during the preliminary agreement phase does not receive an exclusive or protected area. Big Apple Bagels retains the right to offer franchises to others in the same area. However, if the prospective franchisee enters into an Area Development Agreement, they may receive a protected territory as defined in that specific agreement.
For prospective franchisees, this means that initially, when exploring locations and signing a preliminary agreement, there is no guarantee of territorial exclusivity. Big Apple Bagels can grant franchises to other parties, including competitors, in the same area. This initial period requires careful evaluation of potential locations, understanding that other Big Apple Bagels or My Favorite Muffin stores could open nearby.
However, if a prospective franchisee commits to a larger development plan by entering into an Area Development Agreement, Big Apple Bagels may grant a protected territory. The specifics of this territory, including its size and any conditions, are detailed in the Area Development Agreement itself. This offers a degree of security and reduces the risk of direct competition from other Big Apple Bagels franchisees within the defined area.
It is crucial for potential Big Apple Bagels franchisees to understand the terms of both the preliminary agreement and any potential Area Development Agreement regarding territorial rights. During the initial evaluation phase, the lack of exclusivity means a higher risk of competition. If seeking territorial protection is important, negotiating an Area Development Agreement with clearly defined exclusive rights is essential.
