- possession by Franchisee of the approved site, or within ten (10) months from the date of this Agreement;
- ii. Franchisee abandons, surrenders, transfers control of, loses the right to occupy the premises of the BAGELS Store, or fails to actively operate the BAGELS Store [for purposes of this Section, "abandon" shall mean failing to be open for business for three (3) or more consecutive days];
