7. ESTABLISHING YOUR BUSINESS
- 7.1. Site Selection. You must identify and obtain our approval of the site for your Center within 120 days after the Effective Date. The site must be located within the Site Selection Area and conform to our minimum site selection criteria. You must send us a complete site report that includes all all documents, information, photos and video we require. We may accept or reject sites you propose in our commercially reasonable judgment. We try to notify you of our decision within 15 days after we receive all requisite materials. Your site is deemed disapproved if we do not issue our approval within the 15-day period. If we approve the site for your Center before signing this Agreement, we will list the address of your approved site in Part C of ATTACHMENT "A". Otherwise, we list the address of your approved site in the Site Approval Notice. Our approval of a site is not a representation or warranty of any kind, express or implied, of the suitability of the site for a Center. It only means we believe the site meets our minimum criteria.
- 7.2. Lease. If you lease the premises for your Center, you must use best efforts to ensure your landlord signs the prescribed form of Lease Addendum attached to this Agreement as ATTACHMENT "C". If your landlord refuses to do so we may either: (a) waive the Lease Addendum requirement (or the provisions disapproved by the landlord); or (b) require you to find a new site for your Center. What This Means (2025 FDD)
According to Best In Class Education Center's 2025 Franchise Disclosure Document, the site for the education center must be located within a designated "Site Selection Area." The franchisor must approve the site. The franchisee is required to submit a complete site report that includes all necessary documents, information, photos, and videos. Best In Class Education Center has the right to accept or reject proposed sites based on their commercially reasonable judgment. The franchisor tries to notify the franchisee of their decision within 15 days after receiving all the required materials; otherwise, the site is deemed disapproved if approval is not issued within this period.
If Best In Class Education Center approves the site before the Franchise Agreement is signed, the address of the approved site will be listed in Part C of ATTACHMENT "A." Otherwise, the address will be listed in the Site Approval Notice. However, the franchisor's approval of a site does not constitute a representation or warranty of its suitability for a Best In Class Education Center; it only signifies that the site meets the franchisor's minimum criteria.
If the franchisee leases the premises, they must use their best efforts to ensure that the landlord signs the prescribed Lease Addendum attached to the Agreement as ATTACHMENT "C." If the landlord refuses, Best In Class Education Center may either waive the Lease Addendum requirement or require the franchisee to find a new site. The franchisee must promptly provide a copy of the fully executed lease and Lease Addendum to the franchisor for their records and must hire a real estate professional to review and negotiate the letter of intent and lease. If the franchisee hires Best In Class Education Center's recommended real estate professional for these services, the franchisor will contribute $1,000 towards the fees.
