- 3.2. Territory Designation. If we approve the site for your Center before signing this Agreement, we will describe your Center Territory in Part D of ATTACHMENT "A". Otherwise, we will describe your Center Territory in the Site Approval Notice we send to you within 15 days after we approve your site pursuant to §7.1. Within five (5) business days after we send you the Site Approval Notice, you must sign and date the franchisee acknowledgment section and send us a copy for our records. Our approval of the site and designation of your Center Territory is immediately effective and binding at the time we issue the Site Approval Notice even if you do not sign the acknowledgment; provided, however, you have five (5) business days after receipt of the Site Approval Notice to suggest changes to your Center Territory (which may, but need not, accept).

What This Means (2025 FDD)
According to Best In Class Education Center's 2025 Franchise Disclosure Document, if Best In Class Education Center approves a franchisee's site before the franchise agreement is signed, the specifics of the Center Territory will be detailed in Part D of ATTACHMENT "A" of the agreement. If the site is approved after the agreement is signed, the Center Territory details will be provided in a Site Approval Notice sent to the franchisee within 15 days of the site approval, as stated in §7.1.
The franchisee must then acknowledge the Site Approval Notice within five business days. This acknowledgement involves signing, dating, and returning a copy of the notice to Best In Class Education Center. The approval and territory designation become effective immediately upon issuance of the Site Approval Notice, regardless of whether the franchisee has signed the acknowledgment. However, the franchisee has a five-business-day window after receiving the notice to suggest changes to the Center Territory, which Best In Class Education Center may or may not accept.
This process ensures that the franchisee is informed about their exclusive territory, which includes between 15,000 and 18,000 students aged 5 to 17. It also allows for a limited opportunity to negotiate the territory boundaries. The franchisee should carefully review the Site Approval Notice and Center Territory details to understand their market area and potential customer base. Franchisees should also note that Best In Class Education Center reserves the right to modify the Center Territory upon renewal of the franchise agreement.
