- 11.10.Gift Card Program. You must fully participate in any gift card program we establish.
In order to participate, you must: (a) comply with all policies and procedures we establish for participation in the program; (b) purchase (or license) and utilize all equipment, software, mobile applications (Apps), technology and others items we designate as being necessary for participation in the program, and pay all associated fees and costs; and (c) pay us, our affiliate, or a third party designated by us, all program fees and other amounts we designate as being necessary for participation in the program (collectively, "Gift Card Program Participation Rules").
The Gift Card Program Participation Rules may be set forth in the Manual.
We may amend the Gift Card Program Participation Rules at any time and you must immediately comply with all such amendments.
We may determine how gift card proceeds are divided or otherwise accounted for and we may retain proceeds from unredeemed gift cards.
We may also terminate a gift card program and/or require you to participate in a new, additional or successor gift card program.

What This Means (2025 FDD)
According to the 2025 Best In Class Education Center FDD, participation in the gift card program is mandatory. To participate in the gift card program, a franchisee must adhere to the Gift Card Program Participation Rules established by Best In Class Education Center.
These rules require franchisees to comply with all policies and procedures, purchase or license necessary equipment, software, and technology, and pay all associated fees and costs. Franchisees must also pay any program fees or other amounts designated by Best In Class Education Center, its affiliates, or a third party.
Best In Class Education Center retains the right to amend these rules at any time, and franchisees must immediately comply with any changes. The franchisor also determines how gift card proceeds are divided or accounted for and may retain proceeds from unredeemed gift cards. Additionally, Best In Class Education Center can terminate a gift card program or require franchisees to participate in new or additional programs.
