Is a Best In Class Education Center franchisee obligated to offer Special Programs?

We must approve all goods and services you sell. You must offer all goods and services we require, including the specific classes, programs and curriculum we specify. You have the option, but not the obligation, to offer Special Programs. You may only offer Affiliate Programs we approve.

What This Means (2025 FDD)
According to the 2025 Best In Class Education Center FDD, franchisees are not required to offer Special Programs. The FDD specifies that franchisees must offer all goods and services that Best In Class Education Center requires, including specific classes, programs, and curriculum. These required offerings currently include Math and English classes, SAT and ACT preparation courses, and small group or private tutoring in these subjects, along with a variety of other high school subjects.
However, the option to offer Special Programs is left to the discretion of the franchisee. Special Programs are defined as the After-School Program and the Summer Camp Program. The After-School Program involves students attending every day after school for at least 2.5 hours and receiving one packet each of Math and English per week. The Summer Camp Program consists of students attending every day for at least 2.5 hours per day, five days a week during the summer, and also receiving one packet each of Math and English per week.
In addition to the core and optional programs, Best In Class Education Center franchisees may also offer Affiliate Programs, but only with the franchisor's approval. This provides an opportunity for franchisees to potentially increase revenue through partnerships or subleasing, subject to the franchisor's requirements and conditions. The franchisor retains the right to modify the required and authorized goods and services at any time, and franchisees must comply with these changes.
