What This Means (2025 FDD)
According to the 2025 Benjamin Franklin Plumbing FDD, UWIN grants a non-exclusive license to use the Seal in connection with the Customer Complaint Resolution Program and the Contractor's Business. However, this license is revocable. This means that UWIN retains the right to terminate the license under certain conditions.
UWIN also has the right to review and approve all materials displaying the Seal before use and can inspect these materials to ensure proper usage. Benjamin Franklin Plumbing franchisees must comply with UWIN's instructions regarding the Seal's use and make any requested modifications or discontinue its use if directed by UWIN.
This ability for UWIN to revoke the Seal has implications for Benjamin Franklin Plumbing franchisees. It highlights the importance of adhering to UWIN's guidelines and standards for using the Seal. Failure to comply could result in the loss of the license, which could negatively impact the franchisee's marketing and customer relations efforts. The franchisee must stay informed about any changes to the Customer Complaint Resolution Program or the Seal and adapt their operations accordingly to maintain compliance and avoid potential revocation.
Furthermore, upon termination of the UWIN agreement, the Benjamin Franklin Plumbing franchisee must cease all use of the Seal and any association with the UWIN program, removing references from advertising, websites, and business materials. This underscores the importance of understanding the terms and conditions of the UWIN Participation Agreement and maintaining a strong relationship with UWIN to ensure continued participation in the Customer Complaint Resolution Program.
