What This Means (2025 FDD)
According to the 2025 Benjamin Franklin Plumbing Franchise Disclosure Document, all advertising and promotional materials must meet specific standards and specifications set by the franchisor. Franchisees are required to submit any proposed advertising and promotional plans to Benjamin Franklin Plumbing for approval at least 30 days before their intended use, using the method specified by the franchisor. However, materials prepared by Benjamin Franklin Plumbing or previously approved within the last 12 months do not require resubmission. Any advertising plans or materials are considered disapproved unless Benjamin Franklin Plumbing provides written approval within 15 days of submission.
All advertising and promotion must be in approved media, of the approved type and format, and conducted in a dignified manner, conforming to Benjamin Franklin Plumbing's standards. This encompasses all forms of digital and electronic marketing, including websites, social media, and electronic communications. Franchisees must adhere to brand advertising guidelines, which may include disclaimers and warnings prescribed by Benjamin Franklin Plumbing. Franchisees are also responsible for ensuring their employees understand and comply with social media policies.
Benjamin Franklin Plumbing retains ownership of all copyrights and rights to advertising and promotional materials containing the brand's trademarks or related to the franchised business. This includes materials created by the franchisee, franchisor, the Brand Fund, or any cooperative. Franchisees gain no rights or interests in these materials or the trademarks through their participation in advertising programs. This stringent control ensures brand consistency and protects the goodwill associated with the Benjamin Franklin Plumbing brand.
These requirements ensure that all marketing efforts align with the brand's overall strategy and maintain a consistent, professional image. For a prospective franchisee, this means that while they have the freedom to market their local Benjamin Franklin Plumbing franchise, they must do so within the guidelines and with the approval of the franchisor. This can be both a benefit, ensuring high-quality and effective marketing, and a restriction, limiting the franchisee's creative control.
