What payments are due to UWIN upon termination or expiration of the Benjamin Franklin Plumbing agreement?

Upon the termination or expiration of this Agreement for any reason whatsoever, Contractor will forthwith cease to be enrolled in the Customer Complaint Resolution Program and must immediately:
- A. pay UWIN all outstanding and unpaid amounts and charges that have or will thereafter become due hereunder or under any other agreement between Contractor and UWIN, including but not limited to the amount of any Remedial Payments and/or interest on past due Remedial Payments (as described in Section3.4 above);

What This Means (2025 FDD)
According to the 2025 Benjamin Franklin Plumbing Franchise Disclosure Document, upon termination or expiration of the UWIN Participation Agreement, a franchisee must pay UWIN all outstanding and unpaid amounts and charges that have or will become due. This includes any Remedial Payments and/or interest on past due Remedial Payments.
Remedial Payments refer to payments UWIN makes to resolve customer complaints on behalf of the Benjamin Franklin Plumbing franchisee. If a franchisee fails to reimburse UWIN for these payments within 15 days of notification, UWIN can charge a past due service fee. This fee is the lesser of 1.5% per month or the maximum interest rate permitted by law on the overdue amount, starting from the date UWIN made the Remedial Payment.
It is important to note that the franchisee's obligations regarding Remedial Payments continue even after the termination or expiration of the UWIN Participation Agreement. This applies to any work performed by the franchisee before the termination date, as well as any work done while displaying the UWIN Seal, regardless of when the work was performed.
