What This Means (2025 FDD)

According to Benjamin Franklin Plumbing's 2025 Franchise Disclosure Document, while many franchisees may acquire rights for contiguous territories, Benjamin Franklin Plumbing is not obligated to reserve contiguous territories for franchisees. Furthermore, franchisees do not receive an option, right of first refusal, or similar rights to acquire additional franchises within their territory or in contiguous territories. This means that a franchisee's ability to expand their business by acquiring adjacent territories is not guaranteed and is subject to the franchisor's discretion.

This policy has significant implications for franchisees looking to grow their Benjamin Franklin Plumbing business. Without a guaranteed right to expand into contiguous areas, franchisees may face competition from new franchisees or even the franchisor itself in neighboring territories. This lack of territorial control can limit a franchisee's potential market share and revenue growth. It is important to note that the territory size is typically based on population blocks of approximately 100,000 individuals, defined using postal zip codes at the time the territory is defined, but this can vary.

Prospective franchisees should carefully consider this aspect of the franchise agreement and its potential impact on their long-term business strategy. They should inquire about the availability of contiguous territories and the factors that Benjamin Franklin Plumbing considers when awarding new franchises in adjacent areas. Understanding the franchisor's expansion plans and competitive landscape is crucial for making an informed investment decision. Additionally, franchisees should be aware of the minimum performance requirements, as failure to meet these may result in a reduction of the territory size.
