What is the 'Initial 3-Year Period' defined as in the Benjamin Franklin Plumbing Franchise Agreement?
Benjamin_Franklin_Plumbing Franchise · 2025 FDDAnswer from 2025 FDD Document
Beginning on the Original Opening Date and continuing for 36 months thereafter (the "Initial 3-Year Period"), you are required to use a designated call center (the "Call Center") for incoming overflow, after hours, and weekend calls through our designated vendor, currently Call Point. If your customer conversion rate falls below seventy percent (70%) in the Initial 3 Year Period, we may require that you use Call Point, or another designated vendor as your primary answering service to meet the "live" voice requirement. You will pay all fees directly to Call Point. As of the date of this disclosure document, the Call Center Fee is as shown in the table.

What This Means (2025 FDD)
According to the 2025 Benjamin Franklin Plumbing Franchise Disclosure Document, the Initial 3-Year Period is defined as the 36-month period following the Original Opening Date of the franchise. During this period, franchisees are required to use a designated call center for incoming overflow, after-hours, and weekend calls. The designated vendor is currently Call Point.
This requirement has significant implications for new Benjamin Franklin Plumbing franchisees. They must factor in the Call Center Fee when projecting their operating expenses for the first three years. The FDD does not specify the exact Call Center Fee, but it does state that the franchisee will pay all fees directly to Call Point.
Furthermore, if a franchisee's customer conversion rate falls below 70% during this Initial 3-Year Period, Benjamin Franklin Plumbing may require the franchisee to use Call Point (or another designated vendor) as their primary answering service. This could further increase the franchisee's expenses and reduce their control over customer interactions. Prospective franchisees should carefully consider these requirements and their potential impact on their business operations and profitability.
