Where must the Benjamin Franklin Plumbing Franchised Business be established and operated?

2.1. Right Granted.
We grant you the right, and you undertake the obligation, on the terms and conditions of this Agreement, to establish and operate one (1) Franchised Business at the Approved Location only, and to use the Marks and the System only in connection with the Franchised Business, and only within the Territory.
- 6.13. Use of Approved Location; Hours of Operation.
You are required to use the Approved Location only for the operation of the Franchised Business, to keep the Franchised Business open and in normal operation for the minimum hours and days specified in the Brand Standards Manuals (subject to applicable laws), and to not use or permit others to use the Approved Location or the Franchised Business for any other purpose or activity without first obtaining our written consent.
We have the right to vary the minimum hours and days of operation by market, type of facility, or other basis.
2.7. Relocation. You may not relocate the Franchised Business without our prior written consent. Any relocation must be to a location within the Territory. Unless otherwise agreed in writing, relocation of the Franchised Business does not change the Territory.

What This Means (2025 FDD)
According to Benjamin Franklin Plumbing's 2025 Franchise Disclosure Document, the franchise must be established and operated at the Approved Location only. The franchisee is granted the right and is obligated to operate one Franchised Business at the Approved Location and use the brand's marks and system only in connection with that business and within the designated Territory.
The franchisee must use the Approved Location only for the operation of the Franchised Business. They are required to keep the business open for the minimum hours and days specified in the Brand Standards Manuals, adhering to applicable laws. The franchisee cannot use or allow others to use the Approved Location for any other purpose without prior written consent from Benjamin Franklin Plumbing. The franchisor retains the right to modify the minimum hours and days of operation based on market, facility type, or other factors.
The franchisee cannot relocate the Franchised Business without prior written consent from Benjamin Franklin Plumbing, and any relocation must be within the Territory. Unless otherwise agreed in writing, relocating the business does not change the Territory. This ensures that the franchisee operates within a defined geographic area and maintains the brand's standards and operational requirements.
