What This Means (2025 FDD)
According to the 2025 Franchise Disclosure Document, the Benjamin Franklin Plumbing franchise agreement can be executed in counterparts. This means that the agreement can be signed in multiple identical copies, which together constitute a single binding agreement.
For a prospective Benjamin Franklin Plumbing franchisee, this offers flexibility in the signing process. Each party can sign a separate copy of the agreement, which can be particularly useful if the parties are geographically separated. This eliminates the need to send a single document back and forth for signatures, potentially speeding up the execution process.
Additionally, the FDD states that any signature by electronic signature, facsimile, or scanned PDF shall be deemed an original signature. This further streamlines the signing process, allowing for the use of modern technology to expedite the execution of the franchise agreement. This is a common practice in the franchise industry, as it simplifies the administrative aspects of finalizing agreements.
