- 11.5. Copyrighted Materials.
You acknowledge that Franchisor is the owner of certain copyrighted or copyrightable works (the "Works") and that the copyrights in the Works are valuable property.
The Works include, but are not limited to, the Brand Standards Manuals, advertisements, promotional materials, signs, Internet sites, mobile applications, vehicle graphics, and facility designs.
We authorize you to use the Works on the condition that you comply with all of the terms and conditions of this Section 11.
This Agreement does not confer any interest in the Works on you, other than the right to use them in the operation of the Franchised Business in compliance with the terms of this Agreement.
If you prepare any adaptation, translation or other work derived from the Works, whether or not authorized by us, you agree that the material will be our property, and you hereby assign all your right, title and interest therein to us.
You agree to sign any documents we deem necessary to confirm our ownership.
You agree to notify us promptly of any unauthorized use of the Marks or Works that you suspect or of which you have knowledge.
You also agree to inform us promptly of any challenge to the validity of, our ownership of, or our right to license others to use any of the Marks or Works.

What This Means (2025 FDD)
According to the 2025 Franchise Disclosure Document, Benjamin Franklin Plumbing owns certain copyrighted or copyrightable works. These copyrighted works, referred to as "Works," are considered valuable property of the franchisor.
Examples of these copyrighted works include the Brand Standards Manuals, advertisements, promotional materials, signs, Internet sites, mobile applications, vehicle graphics, and facility designs. Benjamin Franklin Plumbing authorizes franchisees to use these works, provided they comply with all terms and conditions outlined in the franchise agreement.
The franchise agreement does not grant franchisees any ownership interest in these copyrighted works, only the right to use them in operating their Benjamin Franklin Plumbing franchise. Any adaptation, translation, or derivative work created from these copyrighted materials, even if unauthorized, becomes the property of the franchisor. Franchisees must sign documents to confirm the franchisor's ownership of these works. Franchisees must also notify Benjamin Franklin Plumbing of any unauthorized use or challenges to the validity of the copyrighted works.
