What This Means (2024 FDD)
According to Benihana's 2024 Franchise Disclosure Document, franchisees must submit any advertising, publicity, signs, decorations, furnishings, equipment, or other materials that use Benihana's marks to BNC for approval before they are published or used. This includes ensuring that any use or depiction of the marks in advertising or other material prepared by the landlord is approved in advance by BNC. This requirement ensures that all marketing and promotional efforts align with Benihana's brand standards and protect the integrity of its trademarks.
This provision gives Benihana control over how its brand is represented in the marketplace, maintaining consistency and quality across all franchise locations. By requiring approval, Benihana can prevent unauthorized or inappropriate use of its marks, which could dilute the brand's value or confuse customers. Franchisees must be proactive in submitting materials for review and allowing sufficient time for the approval process before launching any advertising campaigns or making changes to signage or décor.
For a prospective Benihana franchisee, this means incorporating the approval process into their marketing and advertising timelines. It also highlights the importance of understanding and adhering to Benihana's brand guidelines. While this requirement may add an extra step to the advertising process, it ultimately benefits the franchisee by ensuring that their marketing efforts are consistent with the overall brand image and comply with Benihana's standards. Franchisees should build a good working relationship with Benihana's marketing team to facilitate smooth and efficient approvals.
Benihana also retains the right to revoke approval of any plans or materials with written notice to the franchisee. This allows Benihana to maintain control over its brand image and marketing strategies, ensuring consistency and quality across all franchise locations. Franchisees must comply with any such revocations and adjust their advertising and promotional materials accordingly.
