What This Means (2024 FDD)
Based on the 2024 Benihana Franchise Disclosure Document, franchisees must provide specific documents to Benihana under certain circumstances, but the FDD does not explicitly list the documents required if the franchisee is a partnership. However, the franchisee is required to provide all reports from any governmental agency related to the restaurant to Benihana within five business days of receipt. This includes reports of inspections from health departments or any agency with regulatory oversight of the restaurant.
Additionally, if the franchisee seeks a Successor Franchise Agreement, they must submit all information and documentation reasonably requested by Benihana as a prerequisite for issuing a franchise agreement as of the expiration date of the current franchise term. This suggests that Benihana can request various documents depending on the circumstances.
To fully understand the documentation requirements for a partnership, a prospective Benihana franchisee should directly ask Benihana's franchise development team for a comprehensive list of required documents, both during the initial franchising process and throughout the franchise term. This inquiry should specifically address the obligations of a franchisee operating as a partnership.
