What This Means (2024 FDD)
According to Benihana's 2024 Franchise Disclosure Document, if Benihana establishes procedures, limitations, and regulations regarding the operation of any websites, franchisees must immediately comply with all such procedures, limitations, and regulations. This includes adhering to any website-related rules that Benihana puts in place.
Benihana retains the sole right to establish an Internet "home page" using any of its marks and to regulate the establishment and use of linked home pages by franchisees. This indicates that Benihana maintains control over the brand's online presence and how franchisees can participate in it. Franchisees cannot independently create websites or online content that uses Benihana's trademarks without prior written consent from Benihana.
This requirement ensures brand consistency and quality control across all online platforms associated with Benihana. It also allows Benihana to manage its online reputation and marketing strategies effectively. A prospective franchisee should be aware that they will have limited autonomy in establishing and maintaining an online presence for their Benihana franchise and must adhere to Benihana's established guidelines and any subsequent changes to those guidelines.
