What This Means (2024 FDD)

According to Benihana's 2024 Franchise Disclosure Document, Benihana has the sole right to establish an Internet "home page" using any of its Marks. Benihana also has the right to regulate the establishment and use of linked home pages by franchisees.

Furthermore, franchisees cannot use Benihana's Marks to advertise or sell products or services through the internet without prior written approval from Benihana. Franchisees are prohibited from developing or using any online medium that displays Benihana's Marks without Benihana's prior written consent. If consent is granted, Benihana reserves the right to revoke such consent with written notice to the franchisee.

These stipulations ensure that Benihana maintains control over its brand's online presence and marketing strategies. This is typical in franchising, as franchisors need to protect their brand identity and ensure consistent messaging across all franchise locations. A prospective franchisee should understand that they will have limited autonomy over their online marketing activities and must adhere to Benihana's established procedures and standards.
