What This Means (2024 FDD)
Based on the 2024 Franchise Disclosure Document, Benihana does not specify required actions franchisees must take to verify the employment eligibility of new hires. However, Benihana requires franchisees to ensure certain employees sign confidentiality agreements.
Specifically, Benihana mandates that as a condition of employment, the franchisee must require their General Manager and any personnel with access to confidential information to sign covenants ensuring they will maintain the confidentiality of the information they receive during their employment at the restaurant. These covenants must identify Benihana as a third-party beneficiary, granting Benihana the independent right to enforce them.
The franchisee is further obligated to provide Benihana with copies of all executed confidentiality agreements within five days of hiring the General Manager or any employee with access to confidential information. While this ensures the protection of confidential information, the FDD does not explicitly state any requirements or processes for verifying the legal employment eligibility of new employees.
