What are the specific obligations of Annex Brands franchisees regarding employee training, as detailed in Item 9?

Annex_Brands Franchise · 2025 FDD

Answer from 2025 FDD Document

MANAGEMENT OF THE CENTER AND TRAINING OF PERSONNEL. H. Franchisee agrees at all times to faithfully, honestly and diligently perform obligations under this Agreement, and to exert Franchisee's best efforts to promote and enhance the Center. Franchisee will not engage in any other business or activity that may conflict with Franchisee's obligations under this Agreement. Franchisee agrees not to be associated, either directly or indirectly, with a business competitive with the Center. Franchisee will operate the Center in accordance with the Manuals, and in accordance with the Non-Competition and Non-Solicitation Agreement (Attachment 11). The Center must be under the direct, full-time and on-site management of Franchisee (or a managing partner or shareholder who has satisfactorily completed Franchisor's initial training program) or a manager who has satisfactorily completed Franchisor's initial training program. The person responsible for the day-to-day supervision of the Center will hold no other full-time job. Franchisee will hire all managers, assistant managers and other employees of the Center, and will be exclusively responsible for the terms of their employment and compensation. If a manager will supervise the Center, Franchisee (or a managing partner or shareholder who has satisfactorily completed Franchisor's initial training program) must remain active in overseeing the operation of the Center conducted under the supervision of such manager.

What This Means (2025 FDD)

Based on the 2025 FDD, Annex Brands franchisees are responsible for hiring and managing their own employees, including managers and assistant managers. The franchisee is exclusively responsible for the terms of their employment and compensation. The Center must be under the direct, full-time, on-site management of the franchisee (or a managing partner/shareholder who has satisfactorily completed Annex Brands' initial training program) or a manager who has satisfactorily completed Annex Brands' initial training program. The person responsible for the day-to-day supervision of the Center will not hold any other full-time job. If a manager supervises the Center, the franchisee (or a managing partner/shareholder who has satisfactorily completed Annex Brands' initial training program) must remain active in overseeing the operation of the Center conducted under the supervision of such manager.

Prospective Annex Brands franchisees should note that they or their designated manager must complete the initial training program to oversee the Center's operations. This ensures that the Center operates according to Annex Brands' standards and procedures. The franchisee's active involvement is required even when a manager is in place, emphasizing the franchisee's ultimate responsibility for the Center's performance.

While the FDD excerpt details the franchisee's responsibility for hiring, managing, and compensating employees, it does not specify the exact content, duration, or cost (if any) of ongoing or additional employee training programs beyond the initial training for the franchisee or manager. It also does not detail specific training requirements for different roles within the franchise (e.g., shipping specialists, customer service representatives). A prospective franchisee should inquire with Annex Brands about the availability and requirements of any additional training programs for employees to ensure consistent service quality and operational efficiency.
