What This Means (2025 FDD)
According to Annex Brands' 2025 Franchise Disclosure Document, franchisees are not obligated to use the franchisor's recruiting guidelines. While Annex Brands may provide resources related to recruiting, interviewing, hiring, and managing personnel, the franchisee has the option to use these resources or choose alternative methods.
Annex Brands explicitly states that the franchisee is solely responsible for all aspects of personnel management, including recruiting, hiring, determining employment terms, compensation, payroll, supervision, and disciplinary actions. The FDD emphasizes that the personnel hired by the franchisee are not considered employees, independent contractors, or agents of Annex Brands. This reinforces the franchisee's autonomy in managing their workforce.
This flexibility allows Annex Brands franchisees to tailor their recruiting and personnel practices to best suit their local market conditions and business needs. However, franchisees must ensure that their personnel are trained to operate the Center in a manner that complies with the Annex Brands system, as well as all applicable laws and regulations. Franchisees are encouraged to consult with HR professionals or legal counsel to ensure compliance.
