What This Means (2025 FDD)
According to the 2025 FDD, after the transfer, expiration, termination, or non-renewal of an Annex Brands franchise, the franchisee must promptly inform their telephone service provider, listing agencies, and internet service provider about the termination of their right to use any telephone and fax numbers, directory listings, email addresses, domain names, email marketing programs, social media platforms, online directory listings, or other comparable electronic identities associated with the Annex Brands marks or related to the center.
At Annex Brands's direction, the franchisee must immediately authorize the transfer or termination of the service. If the franchisee fails to do so, they authorize Annex Brands to act as their attorney-in-fact to direct the service providers and listing agencies to transfer the services to Annex Brands or its designee. The service providers and listing agencies can accept the agreement as conclusive evidence of Annex Brands's exclusive right to the telephone and fax numbers, directory listings, email addresses, domain names, email marketing programs, social media platforms, online directory listings, and other comparable electronic identities, and their authority to direct their transfer or termination.
The franchisee also agrees to provide any necessary assistance, documentation, or information to facilitate the transfer of these items to Annex Brands. This ensures that Annex Brands maintains control over its brand identity and customer communications after a franchise agreement ends.
