For a standard Center the Protected Area will be the area within a one-half-mile
radius of the approved location of the Center.
For a flex Center, the Protected Area will be the area within a one-half-mile radius
of the approved location of the Center.
For an express Center, the Protected Area will be the facility in which the Center
is located.

What This Means (2025 FDD)

According to the 2025 Annex Brands Franchise Disclosure Document, a standard Annex Brands center is granted a protected area that extends within a one-half-mile radius of the center's approved location. This means that, under normal circumstances, Annex Brands will not establish or franchise another center of the same type within that half-mile radius, offering the franchisee a degree of territorial exclusivity. However, this protection is contingent upon the franchisee's full compliance with the franchise agreement and related agreements.

Several exceptions exist that could impact the protected area. For example, a Commercial Logistics Center (such as Navis Pack & Ship, Handle with Care Packaging Store, or Pak Mail Freight) may be located within the protected area of a standard or flex Annex Brands center. Similarly, a residential and commercial moving business operated under another of Annex Brands' service marks may also operate within the protected area. Furthermore, Annex Brands retains the right to acquire entities or assets that operate similar businesses within the franchisee's protected area without it being considered a violation of the agreement.

It is also important to note that the grant of a protected area does not guarantee marketing exclusivity. All Annex Brands centers and Commercial Logistics Centers can solicit and service clients and advertise their services to anyone, regardless of their location, including those within another center's protected area. The protected area description can only be amended through a mutual written agreement involving the franchisee, Annex Brands, and any regional licensee for the franchisee's area. This highlights the importance of carefully reviewing the franchise agreement and understanding the scope and limitations of the protected area before investing in an Annex Brands franchise.
