Franchisor will not unreasonably withhold approval of a location that meets its standard site selection criteria for demographic characteristics, population of the area surrounding the site, competition from other businesses, the nature of other business in proximity to the site, commercial characteristics, visibility and accessibility, and the size, appearance and other physical characteristics that determine the suitability of the particular premises.

What This Means (2025 FDD)
According to Annex Brands' 2025 Franchise Disclosure Document, when evaluating a potential site for a new franchise location, Annex Brands considers the 'population of the area surrounding the site' as one of its standard site selection criteria.
Specifically, Annex Brands assesses demographic characteristics, competition from other businesses, the nature of other businesses in proximity to the site, commercial characteristics, visibility and accessibility, and the size, appearance and other physical characteristics that determine the suitability of the particular premises. The population of the area surrounding the site is one of several factors Annex Brands considers when approving a location.
This means that a prospective Annex Brands franchisee needs to find a location that meets Annex Brands' criteria, including population density, to gain approval. If a franchisee proposes a location, Annex Brands has 30 days to approve or disapprove it. If the franchisee cannot find an acceptable site within 365 days of signing the Franchise Agreement, Annex Brands has the right to terminate the agreement.
