What This Means (2025 FDD)

According to Zoomin Groomin's 2025 Franchise Disclosure Document, in the event of a franchisee's death or incapacity, their executor, personal representative, or guardian has specific timeframes to initiate and complete the transfer of the franchise. The FDD defines "incapacity" as a condition preventing the franchisee from performing their duties for 30 consecutive days.

Within 60 days of the franchisee's death or incapacity, the executor, personal representative, or guardian must seek a transfer of the franchisee's rights under the Franchise Agreement. Furthermore, the transfer must be completed within six months of the franchisee's death or incapacity. To complete the transfer, all monies owed to Zoomin Groomin, including the transfer fee, must be paid, and the then-current transfer and release form must be signed.

The prospective transferee must meet certain requirements, including completing Zoomin Groomin's current franchisee application, passing the application screening, completing initial training, and signing either an assignment of rights or Zoomin Groomin's current Franchise Agreement. If these conditions are not met, Zoomin Groomin may terminate the Franchise Agreement.
