Where should a Stretch Zone franchisee note any deficiencies in the franchisor's pre-opening obligations?
Stretch_Zone Franchise · 2025 FDDAnswer from 2025 FDD Document
After we have performed all of our pre-opening obligations and you are open for business, we may request you to sign a certification in the form included in the Operations Manual ("Certificate of Performance") confirming our performance. If, in good faith, you do not believe that we have not completed certain of our pre-opening obligations, you will note the alleged deficiencies on Schedule A of the Certificate of Performance (List of Deficiencies to Certificate of Performance), specifically describing the obligations that you believe we have not performed. What This Means (2025 FDD)
According to Stretch Zone's 2025 Franchise Disclosure Document, after Stretch Zone has performed its pre-opening obligations, they may request that the franchisee sign a Certificate of Performance to confirm their completion of these obligations. If a franchisee believes in good faith that Stretch Zone has not fulfilled certain pre-opening obligations, the franchisee should note these deficiencies on Schedule A of the Certificate of Performance.
Schedule A is specifically designated as the "List of Deficiencies to Certificate of Performance." On this schedule, the franchisee must specifically describe the obligations that they believe Stretch Zone has not performed.
This process allows the franchisee to formally document any discrepancies or unfulfilled obligations, ensuring a record of the issues. This documentation is important for future reference and potential dispute resolution, as it provides a clear and specific account of the franchisor's alleged failures in meeting their pre-opening responsibilities.
