- Franchisee may not advertise and promote the Franchised Business outside of the Designated Territory(ies), unless (a) the geographic area where Franchisee wishes to advertise is contiguous to the Designated Territory(ies) and that area has not been granted in connection with any other Franchised Business, or (b) Franchisor otherwise provides its prior written consent in writing. Nothing in this Section shall prevent or otherwise affect Franchisee's right to continue servicing and corresponding with any Existing Account that Franchisee has assumed in accordance with the terms of this Agreement.

According to Spray Net's 2025 Franchise Disclosure Document, a franchisee is generally restricted to advertising within their designated territory. However, there are two specific conditions under which a Spray Net franchisee may advertise outside of their designated territory.
First, advertising is permitted in geographic areas that are directly adjacent to the franchisee's designated territory, provided that the adjacent area has not been assigned to another Spray Net franchise. This allows a franchisee to reach potential customers in neighboring areas that are not already served by another franchisee.
Second, a Spray Net franchisee can advertise outside their designated territory if they obtain prior written consent from the franchisor. This provides flexibility for the franchisee to pursue advertising opportunities that may extend beyond their immediate territory, subject to the franchisor's approval. This clause also specifies that the franchisee retains the right to continue servicing and communicating with any existing accounts they have assumed under the franchise agreement, regardless of location.
