What This Means (2025 FDD)
Based on the 2025 Spray Net Franchise Disclosure Document, a franchisee cannot purchase additional population for their territory. The agreement does not grant the franchisee the right or option to open additional franchised businesses, nor does it allow them to sub-license or sub-franchise any rights granted to them. The franchisee is restricted to operating within their designated territory as defined in their Data Sheet.
Spray Net retains sole discretion over whether to grant a franchisee the right to open additional franchised businesses. If Spray Net does grant these rights, each new business will be governed by a separate franchise agreement. This means that even if a franchisee desires to expand their territory or customer base, they cannot do so without explicit approval from Spray Net and a new agreement.
Spray Net also reserves specific rights, including operating or licensing others to operate Spray Net businesses outside the franchisee's designated territory. They can also operate businesses under different brands, even within the franchisee's territory, as long as those businesses do not primarily offer painting products and services. This reservation of rights underscores that a Spray Net franchisee's territory is limited and that Spray Net can engage in activities that might compete with the franchisee outside of that territory.
