How long does Spray Net have to notify a franchisee of its approval or disapproval of advertising materials?

Spray_Net Franchise · 2025 FDD

Answer from 2025 FDD Document

All advertising and promotion by Franchisee in any medium must be conducted in a professional manner and shall conform to Franchisor's standards and requirements as set forth in the Manuals or otherwise.

Franchisee shall obtain Franchisor's approval of all advertising and promotional plans and materials twenty (20) days prior to use if such plans and materials have not been prepared by Franchisor or previously approved by Franchisor during the twelve (12) months prior to their proposed use.

Franchisee must submit unapproved plans and materials to Franchisor, and Franchisor will have fifteen (15) days to notify Franchisee of its approval or disapproval of such materials.

If Franchisor does not provide its specific approval of the proposed materials within this fifteen (15) day period, the proposed materials will be deemed rejected.

Any plans and materials that Franchisee submits to Franchisor for its review will become Franchisor's property and there will be no restriction on Franchisor's use or dissemination of such materials.

Once approved, Franchisee may use the proposed materials for a period of ninety (90) days, unless Franchisor prescribes a different time period for use or requires Franchisee to discontinue using the previously-approved materials in writing.

Franchisor may revoke its approval of any previously-approved advertising materials upon notice to Franchisee.

Franchisor reserves the right to require Franchisee to include certain language on all advertising to be used locally by Franchisee or to be used by a Cooperative, including, but not limited to, the phrase "Franchises Available" and references to Franchisor's telephone number and/or website.

What This Means (2025 FDD)

According to Spray Net's 2025 Franchise Disclosure Document, if a franchisee submits advertising and promotional plans or materials that have not been prepared or previously approved by Spray Net, the franchisee must submit them 20 days prior to use. Spray Net then has 15 days to notify the franchisee of its approval or disapproval. If Spray Net fails to provide specific approval within this 15-day period, the materials are considered rejected.

This means a Spray Net franchisee needs to plan their advertising well in advance. They must account for the 20-day submission window and the 15-day review period, totaling 35 days, before they can use any new advertising materials. This requirement ensures that all advertising aligns with Spray Net's brand standards and requirements.

It is important to note that any materials submitted to Spray Net for review become the property of Spray Net, and the company has no restrictions on their use or dissemination. Once approved, the franchisee can use the materials for 90 days, unless Spray Net specifies a different time period or requires the franchisee to stop using the approved materials in writing. Spray Net also retains the right to revoke approval of previously approved advertising materials with notice to the franchisee and can mandate specific language on all local advertising, such as "Franchises Available" or references to Spray Net's contact information.
