Under your Franchise Agreement, we will grant you a non-exclusive license to use our then-current Proprietary Marks solely in connection with your Franchised Business and as authorized in your Franchise Agreement, our Manuals or otherwise by us in writing. What This Means (2025 FDD)

According to Spray Net's 2025 Franchise Disclosure Document, the license granted to franchisees for the use of Proprietary Marks is non-exclusive. This means that Spray Net retains the right to license the same marks to other franchisees or even use them themselves within the same territory or market.

For a prospective Spray Net franchisee, this non-exclusive arrangement has several implications. It means that other franchisees or the franchisor could operate under the same brand within the same general market area. This could potentially lead to increased competition for customers and brand recognition within a given region. While the franchisee has the right to use the marks, they do not have exclusive control over their use in their business operations.

In the franchise industry, trademark licenses can be either exclusive or non-exclusive, and the distinction is important for franchisees to understand. An exclusive license would provide greater territorial protection and limit competition from other franchisees or the franchisor itself. The non-exclusive nature of the license granted by Spray Net means that franchisees need to be prepared to differentiate themselves through service quality, marketing efforts, and customer relationships to succeed in their market.
