Spray_Net Franchise · 2025 FDD

Answer from 2025 FDD Document

The System and Franchised Businesses are primarily identified by the mark SPRAY-NET, as well as certain other trade names, trademarks, service marks and trade dress, all of which Franchisor may modify, update, supplement or substitute in the future (collectively, the "Proprietary Marks").

To develop and maintain high, uniform standards of quality and service and thereby protect Franchisor's reputation and goodwill, as well as that of the System, Franchisee agrees to:

Operate and advertise the Franchised Business only under the Proprietary Marks authorized by Franchisor as specified in this Agreement or the Manuals;

Maintain and display signage and advertising bearing the Proprietary Marks that reflects the current commercial image of the System and, upon notice from Franchisor, to immediately discard and cease use of Proprietary Marks or other imagery that has become obsolete and no longer authorized by Franchisor.

It is understood and agreed that the use by Franchisee of Franchisor's Proprietary Marks applies only in connection with the operation of the Franchised Business at the Premises, and includes only such Proprietary Marks as are now designated, or which may hereafter be designated in the Manuals or otherwise in writing as part of the System (which might or might not be all of the Proprietary Marks pertaining to the System owned by the Franchisor), and does not include any other mark, name, or indicia of origin of Franchisor now existing or which may hereafter be adopted or acquired by Franchisor.

What This Means (2025 FDD)

According to the 2025 Spray Net Franchise Disclosure Document, the Proprietary Marks include the mark SPRAY-NET, along with other trade names, trademarks, service marks, and trade dress. Spray Net may modify, update, supplement, or substitute these marks in the future. Franchisees must operate and advertise their franchised business only under the Proprietary Marks authorized by Spray Net, as specified in the Franchise Agreement or the Manuals.

Spray Net emphasizes the importance of maintaining high, uniform standards of quality and service to protect its reputation and goodwill, as well as that of the System. Franchisees are required to maintain and display signage and advertising that reflects the current commercial image of the System. Upon notice from Spray Net, franchisees must immediately discontinue the use of any Proprietary Marks or imagery that has become obsolete or is no longer authorized.

The agreement specifies that the franchisee's right to use Spray Net's Proprietary Marks applies only to the operation of the franchised business at the designated premises. The permitted use includes only those Proprietary Marks currently designated or later specified in the manuals or in writing as part of the System. This does not extend to any other mark, name, or indicia of origin of Spray Net, whether existing now or adopted in the future. This ensures that franchisees use only approved and current branding elements, maintaining consistency across all Spray Net locations.
