What This Means (2025 FDD)
According to Spray Net's 2025 Franchise Disclosure Document, in the event a franchisee is unable to operate their Spray Net franchise, either the franchisee or their legal representative is responsible for appointing an interim manager to run the business for up to 180 days. This manager must be someone previously approved by Spray Net.
This requirement ensures that the Spray Net business continues to operate under approved management during the franchisee's absence. However, Spray Net is not obligated to operate the franchise or take on any obligations on behalf of the incapacitated franchisee during or after this 180-day period.
In cases of death, disability, or absence, Spray Net has the option, but not the requirement, to step in and operate the franchise on the franchisee's behalf. If Spray Net chooses to do so, it will be at the franchisee's expense, and Spray Net can use the franchise's assets or revenues to cover any outstanding obligations, including amounts owed to Spray Net itself. Spray Net is also entitled to reimbursement for its management services and associated costs. This arrangement provides Spray Net with the flexibility to maintain the business's operations and protect its interests, while also placing the financial responsibility on the franchisee or their estate.
