Can the Spray Net franchisor designate Proprietary Marks in writing other than in the Manuals?

It is understood and agreed that the use by Franchisee of Franchisor's Proprietary Marks applies only in connection with the operation of the Franchised Business at the Premises, and includes only such Proprietary Marks as are now designated, or which may hereafter be designated in the Manuals or otherwise in writing as part of the System (which might or might not be all of the Proprietary Marks pertaining to the System owned by the Franchisor), and does not include any other mark, name, or indicia of origin of Franchisor now existing or which may hereafter be adopted or acquired by Franchisor.

What This Means (2025 FDD)
According to Spray Net's 2025 Franchise Disclosure Document, the franchisor can designate Proprietary Marks in the Manuals or in writing as part of the Spray Net system. The Proprietary Marks apply only when operating the franchised business at the premises.
The document states that the marks include those currently designated or those that may be designated in the future. These marks might not encompass all Proprietary Marks owned by Spray Net.
This means that as a Spray Net franchisee, you must only use the Proprietary Marks that Spray Net authorizes. These marks can be communicated to you through the franchise operations manual or other written communication. Spray Net retains the right to modify these marks, and you must comply with any notifications to discontinue the use of certain marks.
