What This Means (2025 FDD)
According to Spray Net's 2025 Franchise Disclosure Document, the Proprietary Marks that franchisees are authorized to use are designated in the manuals or otherwise in writing as part of the Spray Net system. These marks might not include all of the Proprietary Marks pertaining to the system owned by Spray Net. Franchisees must operate and advertise their franchised business only under the Proprietary Marks authorized by Spray Net, as specified in the franchise agreement or the manuals.
Spray Net franchisees are required to maintain and display signage and advertising that bears the Proprietary Marks, reflecting the current commercial image of the Spray Net system. Upon notification from Spray Net, franchisees must immediately discontinue the use of any Proprietary Marks or imagery that has become obsolete or is no longer authorized. This ensures that all franchisees maintain a consistent and up-to-date brand image.
These Proprietary Marks are the sole property of Spray Net. Franchisees acknowledge that their right to use these marks is contingent upon their full and timely performance under the franchise agreement. Franchisees do not acquire any rights, interests, or claims to the Proprietary Marks, except for the right to use them as prescribed in the agreement. This underscores the importance of adhering to Spray Net's guidelines and standards to maintain the right to use the brand's intellectual property.
