What This Means (2025 FDD)

According to the 2025 Spray Net Franchise Disclosure Document, franchisees are not allowed to use the Proprietary Marks or System for any purpose other than promoting and operating their Franchised Business at the designated premises and within their designated territory. Spray Net retains specific rights, including the right to operate franchised businesses or license others outside the franchisee's designated territory, and to use the Proprietary Marks and System in various channels of distribution, such as online sales or wholesale, without regard to location.

This means a Spray Net franchisee's use of the brand's confidential information and system is strictly limited to their own franchise operations within their defined territory. They cannot expand their use of the system beyond these boundaries without explicit permission from Spray Net, and they certainly cannot duplicate or disseminate confidential information for use outside of the Spray Net system.

This restriction is typical in franchising, as franchisors need to protect their brand, system, and proprietary information. By preventing unauthorized use or duplication, Spray Net can maintain control over its brand standards, protect its competitive advantage, and ensure consistency across all franchise locations. A prospective franchisee should understand these limitations and ensure their business plans align with the permitted use of the Spray Net system and proprietary information.
