Does the commercial use of Proprietary Marks by a Spray Net franchisee benefit the franchisor?

According to Spray Net's 2025 Franchise Disclosure Document, the commercial use of the Proprietary Marks by a franchisee directly benefits the franchisor. The FDD states that any commercial use a franchisee makes of the Proprietary Marks "shall contribute and inure to the commercial use and benefit of Franchisor, which Franchisor may claim to strengthen and further secure ownership of the Proprietary Marks."

This means that as a Spray Net franchisee uses the brand's trademarks and service marks in their daily business operations, the goodwill and recognition associated with those marks increase, which benefits Spray Net. Spray Net franchisees acknowledge that the Proprietary Marks are the sole property of the franchisor. Spray Net retains significant control over the use of its Proprietary Marks. Franchisees must operate and advertise the Franchised Business only under the Proprietary Marks authorized by Spray Net. They must also maintain signage and advertising that reflects the current commercial image of the Spray Net system. Spray Net can modify or substitute the Proprietary Marks, and franchisees are responsible for implementing these changes at their own expense.
