What This Means (2024 FDD)

According to Punch King Fitness's 2024 Franchise Disclosure Document, franchisees must obtain written approval before using any advertising materials. The FDD states that all advertising, promotional plans, and materials displaying the Punch King Fitness Marks must be submitted for prior approval. Franchisees are explicitly prohibited from using advertising materials without receiving written approval from Punch King Fitness. After submission, Punch King Fitness will notify the franchisee of approval or disapproval within fifteen (15) days.

This requirement ensures that all advertising aligns with Punch King Fitness's brand standards and complies with applicable laws and regulations. It allows Punch King Fitness to maintain control over its brand image and ensure consistency across all franchise locations. This is a fairly standard practice in franchising, as franchisors typically want to ensure brand consistency and protect their trademarks.

For a prospective Punch King Fitness franchisee, this means that any local advertising efforts, whether online or offline, must first be vetted and approved by the franchisor. While this may add an extra step to the advertising process, it also provides an opportunity to receive feedback and guidance from Punch King Fitness, potentially improving the effectiveness of advertising campaigns. Franchisees should factor in this approval timeline when planning their marketing activities to avoid delays.

It is important for potential franchisees to understand the specific guidelines and standards that Punch King Fitness uses to evaluate advertising materials. Reviewing examples of approved and disapproved advertisements during the due diligence process can provide valuable insight into the franchisor's expectations and help franchisees create compliant and effective marketing campaigns.
