What This Means (2024 FDD)

According to Punch King Fitness's 2024 Franchise Disclosure Document, Punch King Fitness maintains the right to terminate the National Advertising Fund. However, Punch King Fitness can only terminate the fund after all the money in the fund has been spent on advertising and promotional purposes or returned to the contributors based on their respective contributions. This stipulation ensures that franchisees' contributions are used as intended or returned fairly.

This condition protects franchisees by ensuring that the funds they contribute to the National Advertising Fund are either used for their intended purpose of advertising and promotion or are returned to them proportionally. It prevents Punch King Fitness from simply dissolving the fund and retaining the remaining money for other purposes.

Many franchise systems utilize a national advertising fund, and it is common for the franchisor to have the right to terminate it under certain conditions. The stipulation that all funds must be used for advertising or returned to franchisees is a reasonable safeguard. Prospective Punch King Fitness franchisees should confirm how the fund has been managed historically and what specific procedures are in place for distributing remaining funds if the fund is terminated.
