What This Means (2024 FDD)

According to Punch King Fitness's 2024 Franchise Disclosure Document, the right of termination granted to the franchisor is in addition to, and not in place of, any other legal or equitable remedies available to them. This means that Punch King Fitness retains all other rights and remedies, such as injunctive relief, in addition to the right to terminate the agreement.

This provision is significant for prospective franchisees because it clarifies that Punch King Fitness is not limited to only terminating the agreement if a default occurs. They can also pursue other legal actions to protect their interests. This could include seeking a court order to compel the franchisee to comply with the agreement or seeking monetary damages for any losses suffered as a result of the franchisee's breach.

The FDD specifies that all rights and remedies available to Punch King Fitness are cumulative. This means that the franchisor can pursue any or all of these remedies, either concurrently or consecutively, depending on the circumstances. Franchisees should be aware of the broad range of potential actions that Punch King Fitness can take in the event of a default.
