What This Means (2024 FDD)

Based on the 2024 Punch King Fitness Franchise Disclosure Document, the franchisor can request franchisees to refurbish the Franchised Business at their own expense to conform to the trade dress, color schemes, and presentation of the Marks. This request can be made once every two years during the term of the agreement, excluding any renewal periods, for which additional refurbishment may be required. Such refurbishment may include structural changes, installation of new equipment and signs, remodeling, redecoration, and modifications to existing improvements, and must be completed within the time period specified by Punch King Fitness.

This requirement ensures that all Punch King Fitness locations maintain a consistent brand image and meet the system's standards. For a prospective franchisee, this means they should be prepared to invest in periodic refurbishments to keep their franchise up-to-date with the latest brand standards. The costs associated with these refurbishments can vary significantly depending on the scope of the changes required, potentially involving structural modifications, new equipment, and redecoration.

However, the FDD excerpt does not explicitly state whether Punch King Fitness can require a franchisee to modify the site of the Franchised Business after termination of the franchise agreement. Therefore, it remains unclear if the franchisee has any obligation to alter the site after the agreement ends. A prospective franchisee should seek clarification from the franchisor regarding any post-termination obligations related to site modifications to fully understand their responsibilities.
