What This Means (2024 FDD)
Based on the 2024 Punch King Fitness Franchise Disclosure Document, the franchisor is not required to pay the franchisee any compensation for the franchisor or other franchisees soliciting or accepting orders in the franchisee's territory. Additionally, Punch King Fitness will not be liable to the franchisee for violations by other franchised businesses regarding policies on out-of-territory sales and services.
This means that if Punch King Fitness chooses not to renew a franchise agreement, the franchisee will not be compensated for any potential loss of business due to the franchisor or other franchisees operating within their territory. This could significantly impact the franchisee's revenue and profitability, especially if the franchisor or other franchisees actively solicit customers in the franchisee's designated area.
Prospective franchisees should carefully consider this lack of compensation in the event of non-renewal, as it could lead to financial losses if Punch King Fitness or other franchisees encroach on their territory. It is important to understand the potential risks associated with territory infringement and the lack of recourse in such situations. Franchisees may want to negotiate for stronger territorial protection or compensation clauses to mitigate these risks.
