What This Means (2024 FDD)
According to the 2024 Punch King Fitness Franchise Disclosure Document, the National Advertising Fund is primarily intended for advertising and promotional purposes. Franchisees are required to contribute to this fund, with the understanding that these contributions, along with any earnings, should be used for advertising and promotional activities during the taxable year in which they are made. This suggests that Punch King Fitness aims to maintain a consistent and active marketing presence to support its franchisees.
The funds can cover reasonable salaries, overhead, administrative, accounting, and legal costs incurred by Punch King Fitness in managing the fund and advertising programs. This includes the costs of enforcing contributions to the fund and preparing financial statements. However, the fund's earnings are not meant to directly benefit the franchisor, ensuring that the primary focus remains on advertising and promotion for the benefit of the franchisees and the Punch King Fitness system as a whole.
If there are excess amounts in the National Advertising Fund at the end of the taxable year, Punch King Fitness will use those funds first in the following year. Expenditures will be made first from accumulated earnings from previous years, then from current year earnings, and finally from contributions. This ensures that all contributions are used effectively for advertising and promotional purposes. Franchisees also agree that Punch King Fitness has no direct liability regarding the management of the National Advertising Fund, provided their actions are consistent with the franchise agreement and done in good faith.
