What This Means (2024 FDD)

According to Punch King Fitness's 2024 Franchise Disclosure Document, franchisees must adhere to the System Standards, which encompass the brand's uniform specifications, standards, operating procedures, and rules. These standards are crucial for maintaining consistent operations and protecting the brand's reputation. The System Standards are detailed in the Punch King Fitness Operating Manual and other communications from the franchisor, which may be updated periodically.

Several specific requirements fall under these System Standards. Franchisees must maintain specific insurance coverage, including general liability of $1,000,000, and provide evidence of this insurance to Punch King Fitness. They must also use approved computer systems, including Microsoft Windows OS, Impact Wrap Software, Hardware, and PushPress Gym Management Software, and participate in any designated gift certificate and loyalty programs. Furthermore, franchisees are required to purchase fitness and training equipment from designated or approved suppliers, with approximately 90% of initial purchases and 25% of ongoing costs expected to be from these sources.

Failure to comply with these System Standards can have significant implications for a Punch King Fitness franchisee. While the document does not explicitly state the consequences of non-compliance, it emphasizes the importance of adhering to these standards for the success of the franchisee, the brand, and the network. Non-compliance could potentially lead to penalties, loss of support, or even termination of the franchise agreement, as the franchisor aims to maintain uniformity and quality across all locations.

Prospective franchisees should carefully review the Punch King Fitness Operating Manual and the franchise agreement to fully understand the System Standards and the potential ramifications of failing to meet them. It would be prudent to discuss specific compliance procedures and potential penalties for non-compliance with the franchisor during the due diligence process.
