What This Means (2024 FDD)
According to Punch King Fitness's 2024 Franchise Disclosure Document, the franchisor has the authority to modify, merge, or dissolve any Cooperative. Cooperatives are intended to be of perpetual duration, but this is subject to the franchisor's right to make changes.
For a prospective franchisee, this means that while Cooperatives are intended to be long-lasting, Punch King Fitness retains control over their structure and existence. The franchisor can alter the Cooperative's operations, combine it with another entity, or even terminate it entirely.
If a Cooperative is dissolved, any unexpended funds must be used for advertising or promotional purposes for the Punch King Fitness system. This provides some assurance that the funds will continue to benefit the franchisees, although the specific benefits may vary depending on how the funds are used. Franchisees should inquire about the criteria and process Punch King Fitness uses for modifying or dissolving a Cooperative, as well as how these decisions might impact their individual businesses.
