Answer from 2024 FDD Document

Franchisee may not and is not granted the right to use other channels of distribution, such as the internet, catalog sales, telemarketing, or other direct marketing, to make sales outside of your Territory or operate using other Model Concepts unless we give you written consent to serve another specified area where no other Punch King Fitness franchise or company-owned unit is located. Franchisee acknowledges and agrees to obtain the prior written consent of Franchisor before advertising, offering, or selling beyond the aforementioned grant herein. If Franchisee is granted consent to service another specified area, Franchisee covenants and agrees to be obligated to pay royalty fees and other fees to Franchisor for the services performed or products sold.

What This Means (2024 FDD)

According to Punch King Fitness's 2024 Franchise Disclosure Document, a franchisee is restricted from advertising, offering, or selling outside of their designated territory without first obtaining written consent from the franchisor. This restriction extends to various channels of distribution, including the internet, catalog sales, telemarketing, and other direct marketing methods, as well as operating under different Model Concepts.

If a Punch King Fitness franchisee is granted permission to operate or market outside their territory, they are obligated to pay royalty fees and other fees to the franchisor for any services performed or products sold in that expanded area. This ensures that the franchisor receives compensation for the additional business activity generated by the franchisee outside their initially assigned territory.

The FDD also specifies that any website used by the franchisee is considered advertising and is subject to the franchisor's approval. Punch King Fitness retains the right to control all aspects of the website, including its design, content, and functionality. This control ensures brand consistency and compliance with the franchisor's overall marketing strategy. The franchisor also has the right to establish and maintain a website to promote the Punch King Fitness brand and the franchising of Punch King Fitness businesses.

In summary, a Punch King Fitness franchisee must seek approval before advertising or selling outside their territory and must adhere to the franchisor's guidelines for any online presence. This protects the integrity of the Punch King Fitness brand and ensures fair competition among franchisees.
