CONFIDENTIAL OPERATING MANUAL
A.Business Operations
In order to protect the reputation and goodwill of Punch King Fitness System and to maintain uniform standards of operation under the Marks, Franchisee shall conduct its operations hereunder in accordance with the Operating Manual, as the same may be amended or modified from time to time.
B. Confidentiality
The Operating Manual shall, at all times, remain the sole property of Franchisor. Franchisor treats the Operating Manual and all information contained therein as confidential and proprietary. What This Means (2024 FDD)
According to Punch King Fitness's 2024 Franchise Disclosure Document, franchisees must operate their business in accordance with the Operating Manual to protect the Punch King Fitness System's reputation and maintain consistent standards. This manual, which Punch King Fitness treats as confidential and proprietary, remains the sole property of the franchisor. Franchisees must also treat the Operating Manual as confidential and ensure their employees do the same.
Franchisees are responsible for keeping their copy of the Operating Manual secure, current, and up to date. In case of any discrepancies, the master copy held by Punch King Fitness at its headquarters will be the controlling version. Franchisees must also cooperate in returning any obsolete manuals upon request.
Punch King Fitness has the right to modify the Operations Manual periodically to reflect changes in System Standards. These changes become effective five days after notice is given to the franchisee, or as otherwise directed by Punch King Fitness, and franchisees must comply with these changes at their own expense. Franchisees acknowledge that these modifications may require them to incur costs, which Punch King Fitness cannot estimate in advance. Franchisees also understand the importance of operating the Franchised Business in conformity with Punch King Fitness’s standards and specifications as presented in the Operating Manual and updates, and preserving the confidentiality of the System.
